Even settling an institutional care case may be insufficient
What happens if demand for super-intensive care outstrips supply?
In 2017 Samantha Rhoney and her parents, with assistance from advocacy organizations, sued the US state of North Carolina and its Department of Health and Human Services because, they alleged, her care was inadequate and, worse, being reduced. Samantha, who is now in her 30s, has multiple disabilities including intellectual and developmental disabilities as well as movement disorders.
We could say she “won,” but did she? And did individuals with disabilities “win?”
