How can SET readers learn more about this important civil rights protection?
Section 504 is a part of US federal law that prohibits agencies, organizations, and other entities (including schools) from denying participation in acuities to an individual because she has a disability. Section 504 applies to entities that receive federal financial assistance (e.g., grants) and applies to individuals who have physical or mental impairments that limit major life activities.
One can hear many questions about Section 504 in lots of special education meetings. Doesn’t a student need to be performing below average or grade level to be eligible for protections? Do schools have to provide accommodations that contradict policies that apply to everyone? Don’t kids have to have an IDEA disability to get 504 protections? Many of these questions are based on misunderstandings of the law.
